Terms of Service

1. Introduction

Welcome to Sikerhub. When you access or use our services, these Terms of Service apply to you. Please read them carefully. If you have any problem with the above terms and conditions, kindly do not use this site and its services.

2. Definitions

"Client": A consumer or client, in this case, the individual or organization seeking services from Sikerhub.

"Company": Refers to Sikerhub.

"Services": It includes the following services: search advertising, Social Media Advertising, Creative Design, Web Design and Development, Influencer Marketing, Conversion Rate Optimization (CRO), Search Engine Optimization (SEO), and AI Automation Solutions offered by Sikerhub.

3. Services Provided

Sikerhub offers a comprehensive range of digital marketing services, including but not limited to:

Search Advertising:

‍Managing the Pay-Per-Click (PPC) campaigns to improve the company’s presence on the search engines.

Social Media Advertising:

Creating specific-targeted advertisements on different social networks.

Creative Design:

Making graphics, videos, and other visual materials that are used in the process of conveying information.

Web Design and Development:

‍Creating and implementing effective and convenient websites for clients’ businesses.

Influencer Marketing:

Influencer marketing to market the products or services of the client.

Conversion Rate Optimization (CRO):

Results related to identifying measures that can be taken to improve the percentage of website visitors who take the desired actions.

Search Engine Optimization (SEO): Improve the ranking of a website within the SERPS – organic traffic.AI Automation Solutions: Using AI in client operations through chatbots and auto-responses.

4. Client Responsibilities

Clients are expected to:

• Ensure that all information necessary for the provision of services is correct and without omission.
• Do not provide Sikerhub with any material damaging to third-party rights or in any way unlawful.
• Ensure one works with Sikerhub to ensure services are well coordinated to achieve the set goals.
• Ensure that all third-party content submitted to Sikerhub for use in the services is appropriate and the right to use it has been acquired.

5. Payment Terms

Fees:

The service charges will be agreed upon between Sikerhub and the client in the contract.

Invoicing:

Invoices will be provided at the end of milestones or as stated in the contract between the parties.

Payment Due Date:

Invoices are payable upon receipt if no other terms have been agreed to.

Late Payments:

If payments are made late, this service may attract other charges, as stated in the agreement.

Taxes:

All charges are expressed in US dollars and are exclusive of taxes that will be charged on the invoice when applicable.

6. Intellectual Property

Ownership:

Sikerhub's work developed when rendering services belongs to Sikerhub until payment is made in full.

Transfer of Rights:

After the total payment, the client will own the final deliverables, but third-party elements or pre-existing IP will not be transferred.

Usage Rights:

The Client may use the deliverables only for their intended purpose and only for the duration of the agreed project. They may not be assigned to third parties.

7. Confidentiality

Each of the parties hereto also covenants and agrees that any information furnished by either of them to the other herewith shall be deemed confidential. This may include but is not limited to business strategies, financial data, and clients’ information. No information contained herein shall be disclosed to any third party without the prior written consent of the other party except as required by law.

8. Limitation of Liability

Indirect Damages:

Sikerhub will not accept any liability for indirect, incidental, or consequential damages resulting from using the services.

Total Liability:

Our liability shall not exceed the amount paid by the client for the particular service in question.

Third-Party Services:

Sikerhub is not responsible for any problems caused by third-party products or services that It may recommend or use to provide services.

9. Termination

Termination by Either Party:

Either of them may terminate this agreement with a written notice if the other party commits a material breach of any provision of this agreement and does not correct the breach within the period specified for the breach.

Effect of Termination:

When the contract is terminated, the client must pay for all the services provided up to the termination date. Subject to receipt of payment, Sikerhub will supply the client with all finished work and any work in progress.

10. Governing Law

The terms and conditions of this Site are subject to the laws of the United Arab Emirates. Any controversy or claim arising out of or relating to these terms shall be governed by and construed by the laws of the United Arab Emirates.

11. Amendments

Sikerhub can change the present Terms of Service at any time. The clients will be informed of major changes; however, by continuing to use our services, the clients agree to the modifications.

12. Force Majeure

Sikerhub shall not be liable for any failure to perform its obligations under this agreement where such failure results from events beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, or governmental regulation.

13. Entire Agreement

These Terms of Service and any other documents and agreements referred to herein constitute the entire understanding between Sikerhub and the client regarding the services provided. They shall replace and cancel all previous negotiations and discussions between the parties.

14. Severability

Suppose any of the provisions in these Terms of Service are held by any court or other competent authority to be invalid, unlawful, or unenforceable. In that case, such provision shall be deemed deleted from these Terms of Service. Still, the validity, lawfulness, and enforceability of the remaining provisions contained in these Terms of Service shall not be affected or prejudiced.

15. Waiver

No party shall be deemed to have waived any of the provisions of these Terms of Service if the other party fails to insist on strict performance thereof.

16. Assignment

The client shall not transfer the assignment of any of its rights or duties contained in this agreement with Sikerhub without prior written permission from Sikerhub. Sikerhub may transfer its rights and obligations under this agreement to a third party without the client’s prior permission.

17. Notices

All notices required or permitted under this agreement may be served in writing by personal delivery or by depositing the same in the post office, postage prepaid, addressed to the party for whom intended at the address outlined in this agreement.

18. Independent Contractors

Sikerhub and the client are in a legal relationship as independent contractors. This agreement shall not be construed as constituting the parties hereto partners, joint venturers, or agents of each other for any purpose whatsoever.

19. Survival

The provisions of these Terms of Service that by their nature should continue to have effect after termination or expiry of this agreement shall continue to have effect.

20. Dispute Resolution

If any controversy or claim arises from or relates to this agreement or its breach, the parties shall use their best efforts to settle the dispute. If negotiations cannot solve the problem, it shall be solved through mediation and only thereafter through litigation.
